Your relationship with Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh)
Your use of Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh), mobiles, services, accessories, wearables, websites and application is subject to the terms of a legal agreement between you and Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh). Whose principal place of business is at Police Plaza Concord, Floor-9, Tower-B, Gulshan 01, Dhaka – 1212, this document explains how the agreement is made up, and sets out some of the terms of that agreement.
Unless otherwise agreed in writing with Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh), your agreement with Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) will always include, at a minimum, the terms and conditions set out in this document. These are referred to below as the general terms.

1. Acceptance of Terms

By using Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) mobiles, services, accessories, wearables, websites, and applications, you agree to be bound by these Terms and Conditions. If you do not accept these terms, you may not use the services.

1. Acceptance of Terms

Where this option is made available to you by Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) in the user interface for any service; or by actually using the services. In this case, you understand and agree that Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) will treat your use of the services as acceptance of the terms from that point onwards.

You may not use the services and may not accept the terms if (a) you are not of legal age to form a binding contract with Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh), or (b) you are a person barred from receiving the services under the laws of the Bangladesh

3. Account Security

3.1 You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the services.

3.2 Accordingly, you agree that you will be solely responsible to Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) for all activities that occur under your account.

3.3 If you become aware of any unauthorized use of your password or of your account, you agree to notify Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) immediately.

4. App Content

4.1 You acknowledge that the site contains information, data, software, photographs, graphics, videos, text, images, typefaces, sounds, and other material (collectively “content”) that are protected by copyrights, trademarks, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or herein after developed.

4.2 All content is copyrighted as a collective work under the Bangladesh Copyright laws and we own a copyright in the selection, coordination, arrangement, and enhancement of such content.

4.3 You may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the content, in whole or in part. If no specific restrictions are displayed, you may make copies of select portions of the content, provided that the copies are made only for your personal, information and non-commercial use and that you do not alter or modify the content in any way, and maintain any notices contained in the content, such as all copyright notices, trademark legends, or other proprietary rights notices.

4.4 In addition to the foregoing, use of any software content shall be governed by the software license agreement accompanying such software, if any.

4.5 Online pricing and offers valid for online customers only.

5. Advertisements

5.1 Some of the services are supported by advertisements and sales promotions. These advertisements may be targeted to the content of information stored on the services, new launching, and queries made through the services or other information.

5.2 The manner, mode and extent of advertising by Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) on the services are subject to change without specific notice to you.

5.3 In consideration Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) granting you access to and use of the services, you agree that Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) may place such advertising on the services.

6. Submissions

If you submit, post or otherwise send us any information, content or materials including, without limitation, comments, reviews, data, text, messages, files, images, photographs, videos, audiovisual works, other persons’ names, likenesses, voices, usernames, profiles, actions, appearances, performances and/or other biographical information or material, and any other materials, as well as links to data, text, files, images, photographs, videos, audiovisual works, shall be entitled to unrestricted use of such submissions for any purpose at all, commercial or otherwise, without the requirement of any further permission from or payment to you or to any other person or entity, including without limitation for inclusion in any future gale publication or gale product, with no compensation to you.

No submission shall be subject to any obligation of confidentiality on our part and we shall not be liable for any use or disclosure of any submission. Without limiting the previous, you hereby grant us.

7. Payment and Billing

You must select a payment method to pay us for any purchases you make from us. Every time you use the service, you reaffirm that

  • We or our authorized billing agents are authorized to charge your designated payment method.
  • We may submit charges incurred under your account for payment; and you will be responsible for such charges, even if your membership is cancelled or terminated. You agree that we may charge your payment method for all amounts due to us without additional notice or consent unless required otherwise by law
  • You are responsible for all charges incurred under your account made by you or anyone who uses your account (including your children, family or friends).
  • We may, in our discretion, post charges to your payment method individually or may aggregate your charges with other purchases you make on the site and apply those charges to your next billing cycle. All purchases for mobile, services, accessories, and wearables are final and nonrefundable.
  • You must notify us about any billing problems or discrepancies within 3 days after they first appear on the statement you receive from your bank or Credit Card Company.
  • If you do not bring such problems or discrepancies to our attention within 3 days, you agree that you waive the right to dispute such problems or discrepancies.
  • In case of Order cancellation, the mode of refund payment will be done by transferring through SSL Comerz within 7 to 10 working days. (i.e. we can’t offer your payment as cash).
  • SSL Comerz reserves the right to determine the return amount according to their company policy.
  • All bank discount/cashback offers will be subjected to direct purchase. Any bank discount/cashback offers won’t be applicable while using EMI facility.

 

8. Proof of Identification

Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh), reserves the right to ask for defined proof of identification at the time of delivery. Failure to provide the same to either the Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) or any of its associates, can lead to cancellation of the order. In case of any gift items, customer who has made the transaction online will have to provide his/her proof of identification.

9. Limitation of Liabilit

You hereby agree to fully indemnify, defend and hold our company and its parent and affiliates and their respective officers, directors, employees and licensors harmless from and against any and all claims, liability, losses, costs and expenses (including attorneys’ fees) incurred by you in connection with

(I) Any use or alleged use of Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) products, services through your account by any person, whether or not authorized by you.

(II) Any breach of your representations and warranties and other covenants under this agreement Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, and agree to cooperate with Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) defense of such claim.

Under no circumstances and under no legal theory, tort, contract, strict liability, or otherwise, shall Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) be liable to you or any other person for any indirect, special, incidental, or consequential damages of any character including, without limitation, damages for lost profits, loss of goodwill, work stoppage, accuracy of services, content or results, computer failure or malfunction, damages resulting from disabling of the services provided as part of Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh).

10. Shipping Information

Estimated time of delivery will be 5 days inside Dhaka and 10 days outside Dhaka, from the date of technically and commercially clear order and acceptance.

Shipping charges will be extra otherwise mentioned clearly. Dispatch of goods will be through reputed couriers. Most of the items are shipped within 24-48 working hours after the payment is cleared. Delivery of goods will be made only on weekdays and working days. No delivery during weekends, holidays and after office hours.

Heguang Electronic Distribution Co. Ltd (OPPO Bangladesh) has rights to cancel order at any circumstance. Shipping information will be provided on request only. Shipping and handling fees are non-refundable.

*For Same Day Delivery, Order must be placed within 12.00 PM, except Friday (Applicable for selected products only). Product will be delivered Next Working Day, if the order is placed after 12.00 PM. You can also collect your product from selected OPPO shops located inside Dhaka and selected areas of outside Dhaka.

11. Applicable Taxes

Unless otherwise stated, all prices exclude VAT / TAX as applicable in Bangladesh

12. Warranty

This warranty policy applies only to OPPO cellphones sold in Bangladesh. In the event that performance failure occurs from normal use during the warranty period, OPPO will provide maintenance services free of charge.

In Warranty Quality Commitment

  1. All replacement parts and accessories are brand new.
  2. Replacement parts can enjoy the original remaining warranty period or 6 Month for Motherboard& Display Assembly, 3 Month for Battery and Other Parts from the date of the replacement warranty, whichever is longer.
  3. Please be aware that the discounted old material won’t be covered by a replacement warranty after stocks run out.

In Warranty Instructions and Principles

  1.  A valid warranty card and invoice are required to ensure the basic guarantee of your rights, please be sure to keep them safe;
  2. If you lose the invoice and proof of purchase and are unable to provide a copy of a valid invoice and proof of purchase, we will compare the date exactly three months after the manufacture date of the product and the date of the E-warranty card and select the more beneficial of the two to serve as the de-facto purchase date;
  3. Some accessories (for example: user manual, warranty card, protect shell, etc.) are not covered by this warranty;
  4. Products purchased overseas do not enjoy warranty services in domestic service centers. If you must pay for maintenance, take into consideration material costs and please make an appointment with the Customer Service Center ahead of time;
  5. Accessories (leather casing, screen protector and protective casing) etc. can affect the proper functioning of the phone, if so, you may request the accessories to be replaced without replacing the phone;
  6. All replaced parts are owned by OPPO.

Instruction for Out of Warranty

This warranty does not cover man-made damage nor any of the following conditions, however, paid repair services are available.

  1. Beyond the warranty period
  2. No warranty card and valid proof of purchase, however an exception can be granted if the customer can prove that the phone is within the warranty period;
  3. Non-OPPO official warranty commitments, such as verbal commitments by dealers;
  4. The phone is damaged due to improper use (such as falling, squeezing, liquid damage, etc.);
  5. Damage and malfunction due to uncontrollable external forces (such as floods, fires, earthquakes, lightning strikes and traffic accidents);
  6. Failure to use and maintain the product according to the instructions that lead to damage or malfunction, such as use under extreme temperatures, use of non-OPPO accessories, etc.;
  7. Product natural wear and tear (for example: casing, buttons, display, accessories, etc.);
  8. Disassembly, self-repair, modification, rooting and other human behavior that causes damage.

Labor Fee for OOW Repair:

Labor charges (500 BDT) will be applicable for the following Out of Warranty device repair
  1. Devices that have already exceeded the 1-year warranty period.
  2. Devices that have been damaged by man-made damage or liquid.
  3. Devices that are not official devices of OPPO Bangladesh.

Important Notice and Backup Reminder for Sending Phones for Repair

  1. When sending a phone in for repair, please bring a copy of the valid proof of purchase and the original invoice (purchase voucher and invoice must be completed and sealed by the seller, and may not be altered, otherwise they will be regarded as invalid). Warranty card IMEI serial number stickers must not be torn, or the warranty will be invalid.
  2. Before sending the machine in for repair, please backup and then delete all the data (such as phone numbers, texts, pictures, etc.) that you have stored, so as to avoid any loss or disclosure during subsequent repair. To respect your privacy, OPPO Customer Service Center and its staff will not be responsible for backing up or restoring data for you, and will not be responsible for any consequences resulting from the loss or disclosure of data.
  3. You expressly agree that the use of the unlocking service provided by OPPO and related service provider is at your own risk. Except as otherwise provided by law, OPPO and related service provider does not make any form of ostensive or implied statement, promise or guarantee for the unlocking service. It is not guaranteed that the service will meet your requirements, nor is it guaranteed that the service will not be interrupted. OPPO and related service provider does not make any promises or guarantees on the timeliness, safety, and errors of the service.

Other Information

  1. Under circumstances where the phone has been subjected to damp conditions, liquid damage, or unsupported modification, other issues may occur after the phone has been processed. If the phone is able to make calls before repair but unable to after repair, this is considered to be a problem caused by the error itself and cannot be repaired. The Customer Service Center may require you to sign a separate repair agreement prior to repair according such circumstances;
  2. If the service policy conflicts with national laws and regulations, all the laws and regulations of the country shall take priority.

13. Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the law of Bangladesh and any legal discrepancy or disputes will be heard or proceed in the exclusive jurisdiction of the Bangladesh courts.
